Performance claim lawsuits: what they say about RAM, Siri and sheets

Performance claims are what a company says a product can do, such as how fast computer memory runs, which features a phone will have, or how fine a set of sheets is. Several lawsuits say some of these claims misled buyers of computer memory, iPhones and bedding. These are allegations, and the companies may dispute them. This page lists each lawsuit, what it alleges, and where it stands.

What is a product performance claim?

A performance claim is a statement on a box, a product page or in an ad about how well a product works. Examples include a memory speed printed on RAM, a phone feature shown in a commercial, or the thread count on a sheet set. Thread count is the number of threads woven into one square inch of fabric. Companies use these numbers and promises because shoppers compare them when choosing between products.

According to the FTC's page on truth in advertising, federal law requires that ads be truthful and not misleading, and that companies have evidence to back up the claims they make.

The lawsuits listed here make different claims. The memory cases, the Corsair Gaming memory lawsuit and the G. Skill desktop memory lawsuit, say the advertised speeds were presented as working out of the box. The lawsuits say reaching those speeds required overclocking, which means running parts faster than their default settings, or changing BIOS settings, the computer's built-in startup controls. The Apple Siri Apple Intelligence lawsuit says Apple marketed certain iPhones around a smarter Siri that was not ready. The Sealy thread count lawsuit says the thread count on some sheets was inflated.

Each case is at its own stage, and some may never pay anyone.
