Neutrogena Class Action Lawsuit

Helene Melzer sued Johnson & Johnson Consumer Inc., now known as Kenvue Brands LLC, in May 2022 over Skin360, the Neutrogena tool that took a selfie and told users about their wrinkles, dark circles, fine lines and dark spots. According to the complaint, Skin360 scanned the front and both sides of the face, used Perfect Corp.'s YouCam technology to map more than 200 facial landmark points, and turned each scan into a face template: a set of numbers describing the shape of one person's face. The complaint says users were encouraged to scan twice a day so the app could track their skin over time.

Illinois has a law for exactly this kind of data, the Biometric Information Privacy Act (BIPA). Before a company collects a scan of someone's face geometry, it must tell them in writing, explain why and for how long, get a signed written release, and publish a policy for destroying the data. The lawsuit claims Johnson & Johnson did none of that, and that it used the scans to improve Skin360 and its AI skin coach, NAIA, to sell more Neutrogena products. It also says a pop-up mentioning biometric data first appeared on the Skin360 website in about May 2023, weeks after the mobile apps were discontinued.

Johnson & Johnson denies the claims and says it never collected, stored, shared or profited from anyone's biometric data, and the court never decided who was right. Judge Michael A. Shipp of the U.S. District Court for the District of New Jersey kept the case alive through two motions to dismiss, ruling in March 2025 that Skin360 users are not "patients" under BIPA's health care exemption. After a mediation before retired Judge Wayne Andersen, both sides agreed to settle in October 2025. The lawyers appointed to represent the class, called class counsel, are Parasmo Lieberman Law, Schwartz Law PLLC and Mazie Slater Katz & Freeman, LLC.

Neutrogena Class Action Settlement - $4,700,000

Johnson & Johnson Consumer Inc., now Kenvue Brands LLC, agreed to pay $4.7 million into a settlement fund for people who did a Skin360 skin assessment while they were in Illinois between December 9, 2019, and May 5, 2023. Every version of the tool counts: Neutrogena Skin360, NeoStrata Skin360 and Skin360 versions made with other companies, whether used in the phone app or on the website. The two sides estimate the class at about 11,000 people. Judge Shipp gave the settlement preliminary approval on August 12, 2026.

Several costs come out of the fund before class members are paid. Class counsel will ask for up to one-third of the fund ($1,566,667) in attorneys' fees, plus their costs and expenses. Each of the four people who brought the case may ask for a service award of up to $5,000. Notice and administration are capped at $300,000, and the settlement administrator, Eisner Advisory Group LLC, estimated about $100,000 when the deal was filed. None of the money goes back to the company. Money from uncashed payments is paid out again to class members, and anything left after that goes to a court-approved charity, which the agreement calls the cy pres recipient: the Electronic Privacy Information Center, a privacy nonprofit.

The settlement also changes how Skin360 handles face scans. Within 14 days after the settlement takes effect, the company must confirm it has deleted the images taken during Skin360 assessments in the class period, and it must keep a user notice, a written consent step and a written retention and destruction policy for Skin360. File with Chimo by November 23, 2026. The deadline to opt out or object is November 10, 2026, and the final approval hearing is December 17, 2026.

Deadline for filing a claim: November 23, 2026

Neutrogena Skin360 Class Action Payout: $256 to $731 (est.)

Every approved claim gets the same amount. What is left of the fund after fees, costs, service awards and administration is split evenly among everyone with an approved claim, which the settlement calls a pro rata share, so the more people who file, the smaller each payment. Scanning more often does not earn more, and each person can file only one claim.

Our estimate: about $256 to $731 per claim. That starts from roughly $2.81 million: the $4.7 million fund minus the maximum fee request ($1,566,667), service awards ($20,000) and the administration cap ($300,000), before litigation costs that have not been filed yet. Class counsel used a 35% claim rate when they asked the court to approve the deal; at that rate about 3,850 of the estimated 11,000 class members would file, or about $731 each, and they told the court to expect about $769. If every estimated class member filed, it would be about $256. The actual amount depends on how many valid claims are filed.

The claim form offers Venmo, Zelle, PayPal, a prepaid digital Mastercard or a paper check. Digital payments usually arrive sooner than mailed checks, though that is a tendency rather than a rule, and a prepaid card can leave a small balance that is hard to spend. Eligible payments are sent within 21 days after the settlement becomes final, which comes after the December 17, 2026, hearing and any appeals. Checks expire 90 days after they are issued and are not reissued. Questions about a payment go to the settlement administrator at 1-888-706-4337.

Neutrogena Skin360 Class Action Eligibility

You are in the class if you did a Skin360 skin assessment, scanning your face with any version of Skin360, while you were in Illinois between December 9, 2019, and May 5, 2023. Neutrogena Skin360 and NeoStrata Skin360 both count, in the app or on the website. What matters is where you were when you scanned, not where you live now: a scan done while visiting Illinois counts, and a scan done in another state does not, even by someone who lives in Illinois today. Employees of Johnson & Johnson Consumer, Kenvue and their affiliates are not included.

The claim form asks for your name and contact details, the dates you used Skin360 and, if you no longer live in Illinois, the dates you were in Illinois while using it. It also asks how you want to be paid, and for a Settlement Claim ID if you received one by email. No receipts or screenshots are needed up front, but the administrator may ask for proof of identity or proof that you were in Illinois when you scanned, such as travel records or statements showing purchases in Illinois.

You sign the claim form under penalty of perjury, swearing that you are 18 or older, that you used Skin360 in Illinois during the class period, and that this is the only claim you will file. The administrator reviews every claim for fraud and duplicates and rejects the ones that fail, and a false claim made under oath can lead to prosecution. Claim only what you are sure is true.

FAQ

Skin360 was a Neutrogena skin-analysis tool, in a phone app and on the web, that scanned a selfie and pointed out wrinkles, dark spots and other concerns before recommending products. The mobile apps were discontinued in April 2023, according to the complaint.

No. The class is defined by where you were when you did the Skin360 assessment, not where you live today. A scan done outside Illinois does not count, even if you have since moved to Illinois.

Yes. Anyone who did a Skin360 assessment while in Illinois between December 9, 2019, and May 5, 2023, is in the class. If you no longer live in Illinois, the claim form asks for the dates you were there.

Both count. The settlement covers every version of Skin360, including Neutrogena Skin360, NeoStrata Skin360 and Skin360 versions made with other companies, whether you used the app or the website.

Our estimate is about $256 to $731 per claim. Everyone with an approved claim gets an equal share of the fund after fees and costs, so the final figure depends on how many valid claims are filed.

No proof is required to file. The administrator may later ask for proof of identity or proof you were in Illinois when you scanned, such as travel records or statements showing purchases made in Illinois.

The settlement notice says Johnson & Johnson Consumer Inc. is now known as Kenvue Brands LLC. The lawsuit also claims the company transferred Skin360 users' scans to Kenvue without telling them or asking first.

Within 14 days after the settlement takes effect, the company must confirm it has deleted images taken during Skin360 assessments in the class period, and keep a consent step and a retention policy for Skin360.

Eligible payments are sent within 21 days after the settlement becomes final. That comes after the December 17, 2026, final approval hearing and after any appeals end, which can take more than a year.

None of it goes back to the company. Uncashed payments are redistributed to class members, and anything left after that goes to the Electronic Privacy Information Center, a privacy nonprofit named in the agreement.
