A class action lawsuit has been filed against Michael Kors due to allegations that the company misled consumers by advertising discounted merchandise using improper reference prices at its outlet stores.
The Michael Kors Discounted Merchandise class action case, formally titled McCall et al. v. Michael Kors (USA), Inc., alleges that outlet items were marketed as being offered at steep discounts from original or “compare at” prices that did not reflect genuine former prices. Plaintiffs claim this practice made the discounts appear larger than they actually were, influencing purchasing decisions.
The lawsuit was filed in the Superior Court of California, County of San Diego, under Case No. 25CU041352N. The named plaintiffs—Jennifer McCall, JoEllen Barraclough, and Angela Waldner—brought the action on behalf of U.S. consumers who purchased discounted items at Michael Kors Outlet stores between May 10, 2019 and November 14, 2025. The company denies the allegations.
After litigation, the parties reached a proposed settlement in early 2026, roughly several years after the initial claims arose. The case is represented by Lynch Carpenter, LLP, and includes formal settlement documents, court-approved notices, and a claim process administered through the official settlement website.
The Michael Kors Discounted Merchandise class action settlement resolves claims that the company advertised outlet merchandise at misleading discounts using improper reference prices. While Michael Kors denies wrongdoing, it agreed to a settlement to resolve the lawsuit without further litigation.
The settlement amount is uncapped, meaning that if more people join the lawsuit total payouts will not decrease.
Under the Michael Kors Discounted Merchandise lawsuit settlement, eligible consumers can receive one merchandise certificate worth up to $30 toward a future in-store purchase at a Michael Kors Outlet store. The settlement does not create a fixed cash fund; instead, Michael Kors will issue certificates directly to qualifying class members. Attorneys’ fees of up to $1.985 million and service awards of up to $5,000 per named plaintiff are paid separately by the company.
The Michael Kors Discounted Merchandise settlement amount per person is structured as a merchandise certificate rather than cash. Eligible claimants may receive up to $30 off a single future in-store purchase at a Michael Kors Outlet location.
Great news if you’re a KORSVIP member with a California or Oregon mailing address, you don’t have to file anything. Michael Kors will automatically send you a $30 merchandise certificate if you qualify. That’s pretty unusual for a class action—most settlements force everyone through a claims process, which suppresses participation.
The $30 certificate that will be paid out can be combined with other in-store discounts, which is not always allowed in coupon-based settlements. At the same time, the Michael Kors Outlet pricing payout expires after 90 days and has no cash value.
